These Terms of Service ("Terms") govern your access to and use of the website
hearthandnook.store and any purchase you make from Hearth & Nook ("we," "us,"
"our"). By visiting the site or placing an order, you agree to these Terms. If you do not
agree, do not use the site.
1. Who we are
The site is operated by Hearth & Nook LLC, a limited liability company
organized in New Hampshire, United States. Contact: hearthandnook@hearthandnook.store.
2. Eligibility
You must be at least 18 years old, or the age of majority in your state, and able to form
a binding contract to buy from us. By ordering, you represent that you meet this
requirement and that the information you provide is accurate.
3. Accounts
If you create an account, you are responsible for keeping your password secure and for
all activity under your account. Tell us promptly at hearthandnook@hearthandnook.store if
you suspect unauthorized use.
4. Products, pricing, and availability

Product images and descriptions are provided for reference. Colors, finishes, and
packaging may vary, and specifications (including battery capacity, output, run time,
and weight) are manufacturer figures and approximate. Actual performance depends on
conditions of use. -
All prices are in U.S. dollars and may change at any time before you place an order.

We may limit quantities, discontinue any product, or decline to fulfill orders.

We try to keep the site accurate, but errors in price, description, or availability can
occur. We may correct any error and cancel or refuse an affected order even after it is
submitted, including after payment — in which case we issue a full refund.
5. Orders and acceptance
Your order is an offer to buy. Our order-confirmation email acknowledges receipt but does
not constitute acceptance. A contract is formed only when we dispatch the item. We may
refuse or cancel any order — for example, for suspected fraud, a pricing error, resale or
bulk-purchase activity, or inability to ship to your address — and will refund any
payment taken.
6. Payment
Payment is due in full when you place your order, through the payment methods offered at
checkout. You authorize us and our payment processors to charge your selected method for
the total order amount, including taxes and any shipping charges.
7. Discount codes and promotions
Unless stated otherwise: one discount code per order; codes cannot be combined; codes
have no cash value, are non-transferable, and may be modified or ended at any time. We may
cancel an order and refund it where a code has been used in error, fraudulently, or
outside its stated terms.
Exception: codes issued under our On-Time Guarantee (sent automatically when an order hasn't arrived within 18 business days) can be combined with other discounts. They are single-use and tied to the customer they were sent to. See our Shipping Policy for details.
8. Shipping and delivery
Shipping is governed by our Shipping Policy, incorporated into these Terms. Risk of
loss passes to you on delivery to the carrier; claims for items lost or damaged in
transit are handled as described in the Shipping and Return & Refund policies.
9. Returns and refunds
Returns and refunds are governed by our Return & Refund Policy, incorporated into
these Terms.
10. Safe use of battery products — important
Our products include lithium-ion and lithium-iron-phosphate (LiFePO4) power stations,
jump starters, and power banks. By purchasing, you agree that:

You will read and follow the manufacturer's manual and all safety warnings before use.

You will not exceed the product's rated output or connect loads it is not designed for,
and you will keep it away from water, heat sources, and extreme temperatures. -
You will not open, modify, puncture, incinerate, or attempt to repair the battery unit.

These products are not intended as a power source for life-support or critical
medical equipment. Do not rely on any product as the sole power source for a medical
device. If you use one with medical equipment such as a CPAP, you do so at your own risk
and must have an independent backup. -
Run-time and capacity claims are estimates for typical conditions and are not
guarantees.
11. Product warranty
Products carry the manufacturer's warranty, where one is offered; we will help you
initiate a manufacturer warranty claim. Except as stated in our Return & Refund Policy
and to the extent required by law, products are otherwise sold "as is."
12. Intellectual property
The site and its content — text, graphics, logos, images, and layout — are owned by us or
our licensors and are protected by intellectual-property laws. You may not copy,
reproduce, or use them without our written permission, except to view and use the site
for your own shopping.
13. Reviews and submissions
If you submit a review, comment, or other content, you grant us a non-exclusive,
royalty-free, worldwide license to use, display, and reproduce it in connection with our
business. You are responsible for what you submit; it must be truthful, your own, and free
of unlawful, offensive, or infringing material. We may edit or remove submissions at our
discretion.
14. Prohibited uses
You agree not to use the site to break any law, infringe others' rights, transmit malware,
scrape or harvest data, interfere with the site's operation, or attempt unauthorized
access to our systems.
15. Third-party links
The site may link to third-party sites or services we do not control. We are not
responsible for their content, products, or practices.
16. Disclaimer of warranties
The site is provided "as is" and "as available." To the fullest extent permitted by law,
we disclaim all warranties not expressly stated in these policies, including implied
warranties of merchantability, fitness for a particular purpose, and non-infringement. We
do not warrant that the site will be uninterrupted, secure, or error-free.
17. Limitation of liability
To the fullest extent permitted by law, Hearth & Nook and its owners, employees, and
suppliers will not be liable for any indirect, incidental, special, consequential, or
punitive damages, or for lost profits or data, arising from your use of the site or any
product. Our total liability for any claim relating to a product or order is limited to
the amount you paid for that order. Some jurisdictions do not allow certain limitations,
so parts of this section may not apply to you. Nothing in these Terms limits liability
that cannot be limited by law.
18. Indemnification
You agree to indemnify and hold harmless Hearth & Nook from claims, losses, and expenses
(including reasonable legal fees) arising from your breach of these Terms or misuse of a
product or the site.
19. Governing law and disputes
These Terms are governed by the laws of the State of New Hampshire, without regard to its
conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and
federal courts located in Rockingham County, New Hampshire for any dispute not subject to
small-claims court. You may always bring a qualifying claim in your local small-claims
court.
20. Changes to these Terms
We may update these Terms at any time by posting the revised version here with a new
"last updated" date. Changes apply to orders placed after they are posted.
21. Miscellaneous
If any provision is found unenforceable, the rest remain in effect. Our failure to
enforce a provision is not a waiver. These Terms, together with the policies referenced
above, are the entire agreement between you and us regarding the site and your purchases.
